Due in part to the potentially far-reaching consequences of this conclusion, the IRK is referring questions to the Court of Justice regarding the interpretation of EU law in such circumstances in response to these new developments. These questions mean that the IRK wants to know whether it should indeed refuse to surrender a suspect to an EU Member State when the courts of that Member State can no longer function independently. It is the first time that the Court has been asked these questions. The IRK requests the Court to deal with the questions urgently. The person claimed is in extradition detention and no decision can be made in his case until the questions referred are answered.
