After three days of negotiations, the discussion at the Ministry of Labor on Jabil, a US multinational electronics company that had announced its intention to proceed with the collective dismissal of 190 employees at the Marcianise factory in the Casertano area, stopped on May 25, after three days of negotiations. The decision was taken unilaterally and unexpectedly by the company when the parties were now very close to the agreement, the Ministry of Labor said.

Catalog: nullity of layoffs

Taking note of what was communicated by the Italian representatives of the company, Minister Nunzia Catalfo and Undersecretary Alessandra Todde however expressed their willingness to speak directly with Jabil’s top management, to know the reasons for this inexplicable back-up and try to positively conclude the efforts so far completed, safeguarding the employment continuity of 190 workers. At the table, Catalfo reiterated the “radical nullity of layoffs” due not only to the failure to comply with the procedure for collective redundancies, but also due to the extraordinary measures launched by the Government to face the coronavirus emergency, which provide for the blocking of layoffs and additional weeks of layoffs.

The dispute

The dispute began in June 2019, when Jabil announced 350 redundancies out of a total of 700 employees in Marcianise, the factory purchased by Eriksson in 2015. He was counting on convincing most of the workers to accept the exodus or relocation, but without success. «For several years now – reads a recent note from the company – the Jabil site in Marcianise has had to deal with a challenging economic context, decreasing volumes and underutilized resources. To address the situation, Jabil worked with trade union organizations and stakeholders, both local and national, on a voluntary outplacement program to offer employees an opportunity for re-employment in other local businesses interested in hiring Jabil employees. These companies, which participated in the re-employment program, applied for more workers than the redundant Jabil employees. Despite these efforts and Jabil’s ongoing commitment, unfortunately a disappointing result has been registered to date on joining the re-employment, despite the numerous proposals received, which does not allow us to solve the problem “.
