Transport Online – DAF to court because of truck cartel


AMSTERDAM – MKB-Claim has started legal proceedings against DAF and has sued the truck manufacturer for damage as a result of the truck cartel. Because of secret price agreements between manufacturers, companies have paid too high a price for the purchase of their trucks and suffered consequential damages such as excessive insurance premiums.

For the more than 3,000 affiliated companies, the damage is estimated at 410 million euros. MKB-Claim chooses to take the truck manufacturer based in the Netherlands to court. DAF is jointly and severally liable for all damage caused by the cartel. This manufacturer can in turn recover the damage it has to pay for other brands from the other manufacturers who participated in the cartel. MKB-Claim is conducting the procedure on behalf of the Aequitas Advocacy Foundation.

An average of 16,400 euros in damages per truck

Research by the economic agency engaged by MKB-Claim shows that an average of 10.3 percent was overpaid per truck during the period of the cartel. The amount of the damage depends on the year of purchase and, including statutory interest, can amount to € 30,000 per truck. In addition, MKB-Claim claims overpaid insurance premiums. Customers paid up to 5 percent too much insurance premium, because this premium is partly based on the purchase price of the truck. These costs are also recovered from the cartel by MKB-Claim.

Cartel involvement has already been admitted

In 2018, the parties were already in court in an attempt to reach a settlement under the guidance of the court. This did not lead to settlement negotiations.
