With the positive opinion of the district anti-mafia directorate in Rome and of the National Anti-Mafia and Anti-Terrorism Directorate 41 bis, the hard prison, was revoked to Massimo Carminati. It is learned from sources in the Ministry of Justice.
The Minister of Justice, Alfonso Bonafede signed the decree revoking the 41 bis regime for the former Nar Carminati, one of the defendants in the "Middle World" trial, following the Cassation ruling that dropped the aggravating Mafia association.
The former Nar is currently detained in the prison of Sassari, with a conviction on appeal at 14 and a half years. After the recent sentence of the Cassation, which denied the existence of a mafia association, his sentence will now have to be recalculated by the judges of the Rome appeal.
"Once the mafia-type offense is over, it is inevitable that 41bis has been revoked for Massimo Carminati, or the prison regime," he comments At the Adnkronos the lawyer Giosue Bruno Naso. "Even when the mafia was not recognized at first instance, 41bis was revoked in Carminati and it was admitted to the ordinary prison regime – the lawyer explains – because it was not related to the danger in prison or to information from the judicial police. In fact, Carminati is a prisoner irreproachable, he never had problems with the prison police ".
