Investigations on contracts awarded by the Renault-Nissan alliance with former Justice Minister Rachida Dati and criminologist Alain Bauer were entrusted to three investigating judges, sources told AFP Wednesday. close to the file.
The judicial investigation, which relates to contracts signed when Carlos Ghosn was the CEO of the car group, was opened last summer for facts of"misuse of corporate assets" and of "active and passive corruption"said these sources, confirming information from L'Express.
A preliminary inquiry was opened May 31 in this case, after a complaint filed April 17 by a shareholder of Renault. The complaint, concerning contracts concluded with the Dutch subsidiary of the Renault-Nissan Alliance, RNBV, targeted Rachida Dati, Alain Bauer, but also Carlos Ghosn and his wife.
Counsel for the complainant, Jean-Paul Baduel, had at that time "Suspicions" sure "the reckless use of Renault funds" by his former CEO. "The contracts are doubtful by their amounts, made in favor of a subsidiary having no employee"he had assured AFP.
According to a source close to the file, Rachida Dati would have received 900 000 euros in fees between 2010 and 2012 as a lawyer, paid by RNBV. Alain Bauer would have touched him a million euros between 2012 and 2016. According to their lawyers, the amounts received by their customers have been in regular conditions.
"Rachida Dati is not fooled by all the maneuvers that are emerging", have assured his lawyers, Olivier Pardo and Herve Lehman, in a statement sent to AFP.
"A few days before the decision on the nomination of the candidate LR to the mayor of Paris, (…) the intention to harm is particularly obvious"says the statement.
The names of Rachida Dati and Alain Bauer were cited in an audit of Mazars firm, conducted at the request of Renault and Nissan on RNBV. The investigation, whose findings have been sent to justice, has identified 11 million euros of suspicious expenses incurred by Carlos Ghosn.
A 50-50 subsidiary between Renault and Nissan, RNBV was the structure created by Carlos Ghosn to embody the alliance of the two manufacturers at the operational level. The investigators suspect this structure of having hidden contentious expenses, especially for the personal benefit of Mr Ghosn, currently awaiting trial in Japan for alleged wrongdoing.
